Extent of the contractual guarantee:

The contractual warranty covers defects and malfunctions of the product, with the exception of those resulting from normal wear or caused by use contrary to the instructions in the operating instructions.

In no event shall Baourouge be liable for incidental, direct or consequential, damage resulting from use of the product contrary to its intended purpose, legal or conventional requirements.

Any contractual warranty is excluded if the product has been commissioned in a manner not in accordance with the specifications contained in its user manual, commercial, professional or industrial use, deterioration from shocks, falls, negligence, lack of maintenance or surveillance, or a transformation or repair contrary to the rules of art.

Conditions of the contractual guarantee:

Requests for support under the contractual warranty must be made during the warranty period indicated with Baourouge, by email at contact@baourouge.com

If the defect or malfunction is covered by the contractual warranty, the costs of shipping the product incurred by the consumer will be reimbursed. Otherwise, they will remain at his expense. The return shipping costs of the product are covered by the warranty.

As part of the warranty, Baourouge undertakes to repair the product. In no event shall Baourouge replace the product if a state-of-the-art restoration is possible. If repair of the product is impossible or untimely, Baourouge proceeds either to replace the product, by providing an identical or similar product of at least equivalent quality, or to refund the product, in case of unavailability thereof. The replacement of a product does not extend the duration of the initial warranty.

Baourouge undertakes to intervene as soon as possible. It is recalled that any immobilization period of at least seven days is added to the duration of the contractual guarantee that remains to run, this period running from the request for intervention of the consumer or making available for repair of the property in question, if such provision is subsequent to the request for intervention.

Legal guarantee of conformity:

Non-compliance means a defect that renders the product unsuitable for its intended use or the particular uses, functions or qualities presented by the vendor.

To be covered by the legal guarantee of conformity, the defect must exist at the moment of the delivery of the product to the purchaser.

The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods (ten years for the Precision Slicing Knife),

The lack of conformity, if established, is presumed to exist at the time of the delivery of the product. Baourouge may nevertheless demonstrate the opposite by establishing, by any means, that the defect results, in particular, from an abnormal use of the product or contrary to the recommendations of use contained in its coupon or user’s manual, from a defect maintenance or care, normal wear and tear, commissioning not in accordance with the instructions for use, use for commercial, professional or industrial purposes, deterioration resulting from shocks, falls, negligence, transformation or repair contrary to the rules of art.

Excessive exercise of legal guarantees of conformity and hidden defects, or the contractual guarantee : The legal guarantees of conformity and latent defects, as well as the Baourouge contractual warranty, apply only to products presenting a hidden defect or a lack of conformity rendering them unfit for the use for which they are intended.

These guarantees can not be confused with the right of withdrawal allowing the remote purchaser of a product to return it to obtain a refund, without having to justify reasons or to pay penalties.

In the event that the product is sent to our After-Sales Service for the purpose of obtaining the return of the price, while the product is obviously in perfect working order and has no defect, the costs of sending and forwarding of the product will remain the responsibility of the sender.

The consumer :

– has a period of two years from delivery of the property to act (ten years for the Precision Slicing Knife);

– may choose between the repair or replacement of the property, subject to the cost conditions provided by Article L. 211-9 of the (French) Code of Consumption and Availability;

– is exempted from providing proof that the lack of conformity existed on the day of delivery of the goods.

The legal guarantee of conformity applies independently of the contractual guarantee.

The consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code. In this case, he can choose between the resolution of the sale or a reduction of the selling price in accordance with Article 1644 of the (French) Civil Code.

Reminder of legal guarantees of conformity and hidden defects:

In accordance with the provisions of Article L. 211-15, paragraph 3 of the (French) Consumer Code, Articles L. 211-4, L. 211-5 and L. 211-12 of the (French) Consumer Code, as well as the Article 1641 and the first paragraph of Article 1648 of the (French) Civil Code relating to the guarantee of latent defects and the delay of action, are reproduced below.

« The seller is bound by the guarantee by reason of the hidden defects of the thing sold which renders it unfit for the use for which it is intended, or which so much diminishes that use, that the buyer would not have acquired it, or would have given a lower price, had he known them « (Civil Code, article 1641).

« The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect » (Civil Code, article 1648, paragraph 1). Exceptionally, ten years for the Precision Slicing Knife.

« The seller is required to deliver goods in accordance with the contract and is liable for any lack of conformity existing at the time of delivery. It also responds to any lack of conformity resulting from the packaging, assembly instructions or the installation when it has been charged to it by the contract or has been carried out under its responsibility « (C. consom., Art L. 211-4).

« To be in conformity with the contract, the property must:

1 ° Be fit for the usual expected use of a similar good and, where appropriate:

– correspond to the description given by the seller and possess the qualities that he has presented to the buyer in the form of a sample or a model;

– present the qualities that a buyer may legitimately expect given the public statements made by the seller, the producer or his representative, in particular in advertising or labeling;

2 ° Or have the characteristics defined by mutual agreement by the parties or be fit for any special purpose sought by the buyer, made known to the seller and that the latter has accepted « (C. consom., Art L 211-5).

« The action resulting from the lack of conformity is prescribed by two years from the date of delivery of the goods » (C. consom., Art L. 211-12). Exceptionally, ten years for the Precision Slicing Knife.

Availability of spare parts:

In accordance with the provisions of Articles L. 111-3 and R. 111-3 of the (French) Consumer Code, Baourouge informs the resellers of its products of the period during which the spare parts required for their use will be available so that they can deliver this information. to consumers before the conclusion of the contract.
